General terms and conditions of Sale
These general terms and conditions of sale establish the contractual relations between the branch of the company Jubo Services, Mediation et Consultance Group (JSMCG) S.à.r.l.-S., in this case «Marché Tropical» and its customers. Any order sent to www.marchetropical.lu implies the acceptance of these general conditions of sale.


1. Online purchase
Any order placed by a customer on the website www.marchetropical.lu automatically implies acceptance of these general terms and conditions of sale. No final order can be transmitted without the customer has previously accepted the general conditions of sale by checking the box provided for this purpose. The customer has at all times the possibility to modify or not send his order. 

These general conditions of sale shall prevail over all other conditions contained in any other document, except prior, express and written waiver.


2. Our articles
All our items are represented with their name, brand, content and quantity. The photos of the articles appearing on the website www.tropical.lu are for illustrative purposes, as they may sometimes be modified without notice by the manufacturers. Photos, images and other illustrations of our products are not part of the contractual scope. The responsibility of Marché Tropical can not be engaged in any case on this subject.

The articles found on the website of Marché Tropical are generally available. It is possible that a product cannot be delivered. This missing product will then be deducted from the order and will not be charged. To this end, an informative note will be attached to the delivery note. However, we strive to ensure that our articles are always available. The addition of an article in the cart does not constitute validation of the order because the article in question may not be available between the moment of adding it to the cart and the final dispatch of the order by the customer.


3. Our Prices
The prices displayed on the website www.marchetropical.lu are inclusive of VAT and are valid on the day you visit the site. The delivery of orders is subject to conditions. Unless displayed incorrectly, we guarantee the prices indicated. Marché Tropical cannot be held responsible for a display error.


4. Customer username and password
The username and password will be used as an electronic signature when confirming the order. The customer is solely responsible for their username and password. Marché Tropical will not be held responsible in the case of loss and/ or dishonest use resulting from it. In the case of a forgotten password, the customer has a function on the website allowing him to find it and/ or change it if necessary.


5. Orders
Any order automatically generates an order confirmation sent by email to the address of the customer indicated during the registration of his contact data. Marché Tropical reserves the right not to honor an order during a dispute with the customer. Marché Tropical reserves the right to contact the customer in the case of a large order to verify its accuracy. Marché Tropical reserves the right to limit the quantities sold in order to better manage its available stocks.

In the case of an automatic order, the customer agrees to be delivered weekly on the same day and during the same time slot and this continuously until change by the customer. The customer accepts that prices may fluctuate after the automatic order is activated. The prices of each item in the automatic order may increase or decrease, depending on market price trends. After each order the customer will be contacted by Marché Tropical to schedule the delivery of the items.


6. Payment by credit card
We provide you with the "Worldline" system, a secure and accredited payment system that protects against fraud risks and guarantees the confidentiality of credit card numbers through cryptology. We accept VISA and MasterCard. When paying for the order, the credit card is not charged, but we simply ask for a payment authorization from the banking institutions issuing the credit cards, as a guarantee. The credit card is charged only after verification of the final delivery note on the day of delivery.

 At the time of ordering and payment by credit card, an authorization request is made to the financial institutions issuing the credit cards for the overall amount of the order and a maximum security margin of 10%, this in order to ensure the settlement of differences in weight (meat, fish, fruit, vegetables and any other article that falls into these categories). The order will only be accepted by the system after verification of the credit card. It is therefore up to the customer to check the validity of his credit card and whether it is part of the accepted payment cards.


7. Delivery
For the moment, deliveries take place on Saturdays. Eventually, if with the weather Marché Tropical records a large number of orders and requests for delivery during the week, Marché Tropical reserves the right to define new days of delivery in addition to Saturdays. Delivery is provided by Marché Tropical for the whole of the Grand-Duchy of Luxembourg and the Moselle, including everywhere in the municipality of Perl in Germany and in the municipality of Sierck-Les-Bains in France. When registering, the customer will indicate the exact delivery address he wants to use, including the postal code.


7.1.  Detail of your expenses
The total price of your order, including delivery, is divided as follows: 
a) the total price of your items + 
b) shipping costs according to areas + 
c) packaging costs of 0.50 EUR.

When ordering, the customer will indicate the exact place, date and time of delivery (home, office or other). The articles will then be delivered and/or deposited according to the instructions of the customer. We ship to all Grand-Duchy of Luxembourg’s communes. For buildings without elevator, we guarantee delivery up to the 3rd floor. Beyond the 3rd floor we kindly ask you to come meet our delivery.

Marché Tropical cannot be held responsible in the event of delay or non-delivery of all items ordered. Marché Tropical undertakes to contact the customer and leave him the possibility to postpone or cancel all or part of his order. In case of a total cancellation due to non-delivery, Marché Tropical will refund the full amount of the order.

If the customer is unable to receive the products on the day and time indicated in Marché Tropical, he must notify Marché Tropical as soon as possible, either by e-mail, or by phone, at least 5 hours before the scheduled delivery time. In the event of an unexpected absence from the customer, we will make every effort to drop off the products either in front of or behind the house if weather conditions permit, or at the neighbor’s. We will leave an information note in the client’s mailbox and/or door.

 In case of force majeure and subject to prompt notification to the customer, Marché Tropical will be released from delivery, without entitlement to compensation for the customer. 

Likewise, for any case of force majeure legally recognized, the customer will be released from the receipt of the planned delivery, subject to immediate notification to Marché Tropical, without entitlement to compensation for Marché Tropical. In the event of an error in the wording of the recipient’s contact details when the data is initially entered by the latter, Marché Tropical shall not be held responsible for the impossibility in which it could be to deliver the product(s).


8. Claims
For all fresh and frozen products (meat, fish, fruit, vegetables and any other product of the same category), only claims made on the day of delivery (or the following day until midnight at the latest) will be considered.

Marché Tropical cannot be held responsible for damages of any kind, both material and immaterial or bodily, which could result from the misuse of marketed products. Marché Tropical cannot be held responsible for a deterioration in the quality of products after their deposit with the customer.

Marché Tropical retains, for an unlimited period of time, all electronic exchanges of information relating to sales transactions with the customer, including videos/images from Marché Tropical’s video surveillance system. This information will be used as evidence in the event of a dispute with the client. Once the deadline of 24 hours after delivery has passed, the customer will no longer be able to make a complaint, both with regard to the conformity of the order and the condition of the delivered products. Any accepted delivery will be considered in accordance with the order.

In case of dispute, we will try to find a solution with the client. If, as a result of our attempt, the dispute is still not resolved, the client is free to resort to a mediation/ conciliation procedure. Failing this, the dispute will be brought before the competent Luxembourg court.


9. Right of withdrawal 
For non-perishable products only, the customer has a right of withdrawal allowing him to return them without indication of reason.

This right of withdrawal must be exercised within a period of 14 days from the day of receipt of the goods. The return costs are borne by the buyer. Only undamaged products with original packaging will be refunded or exchanged.

The buyer also undertakes to send a written request for withdrawal by email to info@marchetropical.lu before the return of the goods.


10. Data protection
Dear customer, dear visitor, the protection of your data is a responsibility that we do not take lightly. Any processing of personal information communicated to Marché Tropical is carried out under the sole responsibility of Odoo SA.However, in accordance with the law, you have a right to access, modify, correct and delete information about yourself.

10.1. Personal data
The personal data collected when creating an account on www.marchetropical.lu are strictly limited to the data necessary for the provision of our services, namely title, name, first name, address(s), telephone number and e-mail address. Obviously, the data of your placed orders are also saved. These data are only processed by Odoo SA and are never communicated to third parties (with the exception of the telephone number _ see paragraph 10.4: "SMS notifications").

10.2. Cookies
Marché Tropical uses "cookies", a common technique, as many online shops, necessary for the proper functioning of its website. For more information, please refer to the following link: https://fr.wikipedia.org/wiki/Cookie_(informatics). You have the option to delete and/or block cookies. However, this will prevent our website from working properly.

10.3. Traffic Tracking
Marché Tropical uses three visitor tracking systems, including Google Analytics, Facebook Pixel and Microsoft Clarity. These systems use "cookies" to collect information about the use of our site. This information is never linked to the personal data of your Marché Tropical account. As long as you are not logged into your Facebook, Google or Microsoft account (or if you do not have one), the information collected is completely anonymous.

Otherwise, please refer to the general data protection policy of your Facebook, Google and/or Microsoft account.

10.4. SMS Notifications
We use SMS notifications to inform our customers about their delivery(s) and/or the availability of new products that may interest them. These SMS messages are sent through the "BulkSMS" service (www.bulksms.com). For this, we are obliged to communicate only the telephone number and the text of the message to this service, without mentioning any other personal data.

11. Intellectual property
Any reproduction of this site, in whole or in part, in the Grand-Duchy of Luxembourg or abroad is strictly prohibited in view of the legal provisions in force regarding intellectual and artistic property. Any commercial use of it is illegal and will be subject to legal action.
